Acting fast protects your health and your rights. Here's what to do:
Most workers qualify. You need to be an actual employee (not an independent contractor) who was hurt while performing your job duties. It also doesn't matter if it was your fault — workers' compensation is a no-fault system.
Covered: Full-time, part-time, temporary, and undocumented workers. Injuries include sudden accidents, repetitive stress, occupational diseases, and work-related mental health conditions.
Not covered: Independent contractors, volunteers, and federal employees (they have separate work injury compensation systems). You also can’t get workers’ comp benefits if you were injured at work while drunk, high, or even hurt yourself on purpose.
Even if your employer lacks insurance (illegal in California), you can get benefits through the state's Uninsured Employers Benefits Trust Fund. Not sure about your status? We can review your situation and determine your eligibility during a free consultation.
Start by reporting your injury to your supervisor immediately and getting the DWC-1 claim form. Fill out your section completely and be specific about what happened. Your employer sends it to their workers’ compensation insurance company.
The insurance company has 14 days to accept or reject the claim. During the claim review period, they must cover up to $10,000 in medical care. If the insurance company doesn’t respond at all (either accepting or denying the claim) within 90 days, it means automatic approval.
